Shipping and Returns Policy
1. Shipping Origin
All artworks are dispatched from our gallery in Tassin la Demi-Lune, France, in the Lyon metropolitan area. We ship to the United States and Canada.
2. Processing Time
|
Orders are processed within one to three business days of payment confirmation. |
This window is required for careful packing, preparation of export customs documentation, and handover to the carrier. For artworks requiring an export licence under the French Code du patrimoine, processing time may extend to six weeks. See Section 8. |
3. Carriers and Shipping Methods
We use tracked, signature-required international express services only: UPS Express Saver.
We do not use standard postal services such as La Poste, Colissimo or USPS First Class for paintings, regardless of declared value, because they lack adequate handling protocols for framed works.
4. Estimated Delivery Times
Total delivery time, including processing, is typically five to nine business days. Transit times are carrier estimates and do not include customs clearance delays.
- United States: 4 to 6 business days in transit with UPS Express Saver.
- Canada: 4 to 6 business days in transit with UPS Express Saver.
5. Shipping Costs
Free shipping
Shipping is free to the United States and Canada on every order, whatever the size or the value of the painting. No shipping charge is added at checkout, and no surcharge applies to large or heavily framed works.
We currently ship to these two countries only.
6. Our Responsibility in Transit
Every painting travels at our risk until it reaches you. In the event of loss or total damage in transit, you receive a full refund or, where possible, a replacement of equivalent value.
Partial damage is addressed under Section 10.
7. Customs Duties, Import Taxes, and VAT
GalerieClub Fine Art is VAT-exempt on export sales to buyers outside the European Union, under article 262 I of the French General Tax Code. Prices displayed for US and Canadian buyers do not include French VAT.
The buyer is the importer of record in the destination country, and is responsible for any import duties, taxes, customs fees or clearance charges levied there.
Original paintings are declared under HS heading 9701, which covers paintings, drawings and pastels executed entirely by hand.
Duty treatment of original works of art varies by country and is subject to change. Buyers are advised to confirm current rates with their national customs authority before purchase.
- United States. A Merchandise Processing Fee may be charged by Customs on formal entries, currently 0.3464% of the declared value, with a minimum and a maximum set by regulation.
- Canada. GST or HST applies at 5% to 15% depending on province, calculated on the declared value.
- Both countries. Carriers charge their own clearance fee, usually a modest fixed amount, billed to the recipient.
We declare the true sale price on the customs invoice. Under-declaration of value is illegal and will not be performed under any circumstance, regardless of buyer request.
What happens at the border. Your painting is collected by UPS and travels to your country. Customs assess whether any local tax or processing fee applies, based on the declared value and the nature of the item. The carrier then contacts you directly, usually by phone or email, to confirm your details and tell you what is due. You pay the carrier, and the painting is delivered.
8. Cultural Heritage Export, French Code du Patrimoine
Under the French Code du patrimoine, the export of certain original paintings outside the European Union requires a certificat de libre circulation delivered by the Ministry of Culture, depending on the age and value of the work.
Artworks in our usual price range are generally not concerned. Buyers are notified before shipment if a licence is required, and we retain export documentation for all sales. Where a licence is needed, processing adds two to six weeks.
9. Delivery, Receipt, and Inspection
A signature from an adult is required upon delivery. We strongly recommend the buyer:
- Inspect the outer packaging for visible damage before signing.
- If damage is visible, sign "received with visible damage, subject to inspection".
- Photograph the outer packaging from all angles before opening.
- Unbox in a clean, well-lit area and photograph the artwork within 48 hours of receipt.
10. Damage in Transit
If the artwork arrives damaged, notify us within forty-eight hours of delivery at galerieclub1(arobase)gmail.com, with photographs of the outer packaging from all sides, photographs of the artwork showing the damage, the signed delivery slip, and the carrier's waybill number.
Resolution options are a full refund on return of the damaged artwork, a partial refund if you elect to keep the work, or funded professional restoration by a conservator of our mutual choice.
11. Returns for US and Canada Buyers
For buyers in the United States and Canada, where no legal right of withdrawal applies, we voluntarily grant fourteen calendar days from delivery to examine the artwork and notify us of a return.
As custodians of the works we offer, we reserve the right to decline a return where we have reason to believe it is not made in good faith. This is intended to prevent antique and collectible artworks from undergoing unnecessary international shipping, which carries inherent risks to their preservation.
Once a return has been accepted, the artwork must be sent back to our Tassin la Demi-Lune address within fourteen calendar days, at the buyer's expense, using a tracked and signature-required service, in the original packaging or equivalent. The buyer sends us the tracking number on despatch.
Important
The artwork travels at the buyer's risk until it reaches us. The buyer is responsible for arranging any transit cover he considers necessary. If a returned artwork is lost or damaged in transit, no refund is due, and any claim is made by the buyer with his own carrier.
The artwork must be returned in the exact condition in which it was delivered. Any diminution in value resulting from handling beyond what is necessary to establish the nature and characteristics of the artwork may be charged to the buyer.
12. Non-Returnable Situations
- Returns notified after expiry of the fourteen-day window described in Section 11.
- Artworks returned in packaging materially inferior to the original, where the risk of transit damage on return is significant.
13. Refunds, Method and Timing
Refunds are issued to the original payment method used at purchase, whether credit card, Shopify Payments, PayPal or bank wire.
Refunds are processed within fourteen days of our receipt and condition-verification of the returned artwork, subject to the processing delays of the payment provider. You are informed by email when the refund is initiated.
14. Partial Refunds and Deductions
We reserve the right to apply a partial refund only, or to charge the buyer for diminution in value, in the following cases:
- Return of an artwork with new handling marks, scratches, dents or frame damage not present at delivery.
- Return after visible unauthorised cleaning, retouching or varnishing.
15. Lost or Stolen Packages After Delivery
Our liability ceases upon carrier-confirmed delivery with signature at the address supplied by the buyer.
If a package is reported as delivered but not received, the buyer must file a claim directly with the carrier within seven days of the confirmed delivery date.
